Acceptable Use Policy
Prohibited Activities. Customer will not, and will not permit any persons ("Users") using Customer's online facilities and/or services, including, but not limited to, Customer's Web site(s) and transmission capabilities, to do any of the following ("Prohibited Activities"):
a.. Transmission, distribution or storage of any material in violation of any applicable law or regulation. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
b.. Sending unsolicited mail/usenet messages, including the sending of "junk mail" or other advertising material to individuals who did not specifically request such material. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, and political tracts. A user shall not use another site's mail or usenet servers to relay messages without the express permission of the site.
c.. Spamvertised websites are prohibited. Generating SPAM from within our network infrastructure or relaying SPAM through machines housed on our network is prohibited. Performing nameservice for domains engaged in these practices is prohibited.
d.. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking"), including any unauthorized access, alteration, destruction, or any attempt thereof, of any information of any RUSHDSL Inc. customers or end-users by any means or device.
e.. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
f.. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
g.. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
h.. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
i.. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
j.. Knowingly engage in any activities that will cause a denial-of-service (e.g., synchronized number sequence attacks), whether on the RUSHDSL Inc's network or on another provider's network.
k.. Using RUSHDSL Inc. Products and Services to interfere with the use of the RUSHDSL Inc. network by other customers or authorized users. The Acceptable Use Policy (AUP) is not exhaustive and RUSHDSL Inc. reserves the right to modify the AUP at any time.
No credits will be issued for any interruption in service resulting from policy violations.
INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A RUSHDSL INC. CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.
RUSHDSL Inc. will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected.
Remedy. RUSHDSL Inc. reserves the right to suspend network access to any customer if, in the judgment of the RUSHDSL Inc. network administrators, the customer's server is the source or target of the violation of any of the other terms of the AUP. If inappropriate activity is detected, all accounts of the Customer in question may be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended.
Violators of the policy are responsible, without limitations, for the cost of labor to cleanup and correct any damage done to the operation of the network and business operations supported by the network, and to respond to complaints incurred by RUSHDSL Inc.. Such labor is categorized as emergency security breach recovery and is currently charged at $250 USD per incident per hour required.

Suspension and Termination of Service. RUSHDSL Inc. reserves the right to suspend and/or terminate a Customer's Service at any time for any material failure of Customer, its Representatives or its Users to comply with these Policies and Procedures.
Email/Usenet policy and acceptable procedures
Email/Usenet access is provided to all dialup customers of RUSHDSL Inc. Customers are free to subscribe to as many or as few newsgroups as they wish. In conjunction with established Usenet protocols, RUSHDSL Inc. advises customers not to post to newsgroups until the customer has familiarized themselves with the subjects and established guidelines of the newsgroup. Some restrictions of newsgroup postings have been established by Usenet and are respected by RUSHDSL Inc. Customers unconditionally agree to these protocols and policies with their account. These include:
Post articles to groups pertaining to the posting. Inappropriate postings are not appreciated by participants of newsgroups nor are they allowed under Usenet protocols.
Some newsgroups do not allow commercial postings. Users are encouraged to verify this before making any such posting. Irresponsible blanket postings to all or large numbers of newsgroups simultaneously with disregard to the newsgroups subject is forbidden.
Chain letters are not allowed to be posted or mailed. Harassment, whether through language, frequency, or size of messages, is prohibited. Customers may not send email to any person who does not wish to receive it. If a recipient asks to stop receiving email, the customer must not send that person any further email. Customers are explicitly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it. Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings. Malicious email, including but not limited to "mailbombing" (flooding a user or site with very large or numerous pieces of email), is prohibited. Forging of header information is not permitted.
Accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider.
Irresponsible newsgroup postings which result in large numbers of complaints to RUSHDSL Inc. News Administrator may result in a customers account being disabled
Only the RUSHDSL Inc. News Administrator may create new Usenet groups. Any abuse of this policy will result in a customers account being disabled and all other previous agreements rendered null and void.
Any disregard for the above conditions may result in an account being disabled.
RUSHDSL reserves the right to remove any email held on our mail server for longer than 60 days. It is the customer's responsibility to periodically download their mail to their local computer for continued storage.
VIOLATION of ANY OF THESE TERMS WILL RESULT IN IMMEDIATE TERMINATION OF SERVICES. Furthermore, violation of any of these terms, relating to the terms described within this email/usenet policy section of this document, will result in the IMMEDIATE CHARGE of $500 per incident as well as an additional $500 per unsolicited message sent by the customer up to a maximum charge of $10,000 USD. RUSHDSL RESERVES THE RIGHT TO CHARGE USER'S CREDIT CARD, IF ON FILE FOR USE IN PAYMENT OF RUSHDSL SERVICES, THE ABOVE AMOUNTS FOR VIOLATION OF THESE TERMS. IN THE EVENT USER PRE-PAYS FOR THEIR SERVICE VIA CASH, CHECK, OR MEANS OTHER THAN CREDIT CARD, RUSHDSL RESERVES THE RIGHT TO INVOICE AND HOLD USER RESPONSIBLE FOR THE CHARGES LISTED ABOVE PER VIOLATION OF THESE TERMS. User also agrees to the immediate termination of RUSHDSL services for violation of any of these terms.

Customer responsibility and cooperation.
All customers and subscribers of RUSHDSL Inc. agree unconditionally to not in any way intentionally or maliciously cause harm to the equipment, software, or processes operating RUSHDSL Inc. Any violations of this agreement will result in civil and/or criminal penalties as prescribed by local, state and federal laws applicable in this area.
The Internet hosts some material deemed unfit for viewing and reading by minors under the age of 18. Some sites contain information both in text and graphical formats that may be considered obscene or harmful. Customers and subscribers of RUSHDSL Inc's services will not hold RUSHDSL Inc. responsible for sites and postings, which could be considered obscene, lewd, offensive and/or harmful. It is RUSHDSL Inc. policy that individuals are responsible for their own monitoring and viewing habits and those minors in their care. We currently do not filter or screen postings or sites on the Internet as a whole nor do we plan to in the foreseeable future. Customers and subscribers possibly offended by such material are encouraged to explore software options that block or filter sites that may be deemed unsuitable.
In addition to this, customers and subscribers are encouraged to use common sense and courtesy when creating postings and or sites on The WWW server that may be considered offensive to others. Also we ask that those customers using our WWW Page services keep all Adult or Sexual Content off their pages as we have a PG-13 rating on User Pages because of children and adults on our service that do not enjoy such content. If a customer has Adult or Sexual Content of Vulgar origin and is asked to remove the page and doesn't they will have the page immediately removed and will be subject to disconnection.
